The practice of turning off hot water in Kiev in the summer months has long become familiar to residents of the capital. But this summer, the lack of hot water has become a massive problem. And it is connected not only with traditional pipe repairs.

In the summer of 2018, a third of Kiev residents were held hostage by a debt dispute between the capital's mayor's office, Naftogaz under the leadership of Andrey Kobolev and the Kyivenergo company controlled by Rinat Akhmetov. While they are deciding which of them and to whom owes money, residents of the capital are left without hot water and with the prospect of being left without heat in winter.

The journalists of Channel 24 figured out what happened, who is to blame and what to do about it.

Is there no hot water everywhere in Kiev?

Now - not everywhere. So far, without hot water in Kiev, there are about 3 thousand houses (about a third of the entire capital). But very soon - after August 1 - there is a risk that hot water will disappear from all the capital's houses.

The company "Kyivenergo", which has been owned by Rinat Akhmetov for the last seven years, has been managing the heating industry in Kiev and has been supplying hot water and heating to the people of Kiev since 2001. At the end of April this year, the agreement with Kyivenergo expired. The Kiev authorities decided not to renew it. Officially, because Kyivenergo was ineffective. Therefore, from May 1, heating networks, heating points, boiler houses and meters were transferred to the newly created communal enterprise "Kievteploenergo". CHP-5 and CHP-6, together with the Energia incineration plant, will remain in the management of Kyivenergo until August.

CHPP-5 supplies hot water for residents of the city center, Rusanovka, Poznyakov, Bereznyakov, Teremkov, Lobanovsky Avenue, Chokolovka, parts of Pechersk and Borschagovka. CHP-6 - for Troyeshchina, Lesnoy, Severo-Brovarsky, Voskresenka, Vinogradar and part of Obolon. The Energia waste incineration plant supplies hot water to several hundred houses in Poznyaki.

Those houses that could not be connected to either CHP-5, CHP-6, or Energia were provided hot water thanks to a number of boiler houses in Svyatoshinsky, Shevchenkovsky, Solomensky, Podolsky, Goloseevsky, part of Obolonsky, Darnitsky and Pechersky districts. These boiler houses themselves were the first to be taken on the balance sheet and stopped.

Why did it happen?

In short, because Kyivenergo had an agreement with Naftogaz on gas supply, but Kievteploenergo did not. And Naftogaz refuses to conclude an agreement with him. Therefore, "Kievteploenergo", which is supposed to provide the people of Kiev with heat, hot water and electricity, does not receive gas.

Why doesn't it get? Everything is confusing here, but let's try to explain it as simply as possible. Because Naftogaz refuses to sign contracts for the supply of gas with Kievteploenergo because of the billion-dollar debt of Akhmetov's company. The logic of "Naftogaz" is as follows: whoever has assets, then undertakes to pay off debts. Kyivenergo completed the previous heating season with more than UAH 5 billion in debt to Naftogaz. When the management of the heat economy of the capital was transferred from Kyivenergo to Kievteploenergo, these debts were transferred with it. And until they are paid off, Naftogaz refuses to conclude an agreement on gas supply to Kievteploenergo.

Is Akhmetov really to blame for the lack of water?

Partially. The parties are trying to sort out this dispute in court. The Kiev Economic Court did not satisfy the statement of the Kyivenergo energy company to replace the debtor with the Kievteploenergo utility company.

The court ordered Akhmetov's company to pay Naftogaz 170 million hryvnia. However, this decision will not return hot water to the people of Kiev. After all, Akhmetov was ordered to pay only 4% of the debt that Naftogaz counted for his successors. And the monopolist promises to provide fuel only after paying the entire amount - almost 5 billion hryvnia. Because, we recall, Naftogaz insists that together with the property of Kyivenergo, Kyivteploenergo received all the debts.

The capital's authorities, meanwhile, note that such demands of Naftogaz contradict both the Constitution of Ukraine and the norms of international law. They, as the KSCA insist, are unfair in relation to the community of Kiev, because by means of the residents of the city of Kiev they are forced to pay off debts, including fines and penalties charged to another structure. The city authorities are demanding to return gas to heat generation facilities, allowing the resumption of hot water supplies to the Kievites, and to resolve the issue of debts without affecting the city's life. The issue of the constitutionality of Naftogaz's claims to recognize Kievteploenergo as the legal successor of Kyivenergo's debt obligations will be decided by the Supreme Court. Meanwhile, the people of Kiev remain hostages of this dispute.

When will hot water be returned to Kiev?

Press secretary of the deputy chairman of the Kyiv City State Administration Petr Panteleev Yulia Literatnaya explained to Channel 24 that now the answer to this question depends entirely on whether Naftogaz Ukrainy will show flexibility in negotiations with the capital's authorities on gas supplies.

The situation is very serious indeed. After August 1, we take over the management of CHP-5 and CHP-6 - the largest CHP plants in Ukraine, which are engaged in the production of heat and electricity. What should the people of Kiev do?

Wait and believe. Everyone who is possible is already involved in solving this issue: people's deputies, the National Commission for state regulation in the field of energy and utilities, government representatives, the supervisory board of Naftogaz, the prime minister, and the president. However, until the parties find out on whose shoulders the billions in debts will fall, residents of the city should not rely on the availability of hot water.

What are the ways to solve the problem?

One of possible options- restructuring of Kyivenergo's debt until 2021, which will become possible only after the final amount of the debt has been agreed upon.

By the way, Kiev is not the only city that has faced the problem of hot water. A similar situation has developed in Kharkov. There city heating networks promised to return hot water three times already - on September 11, September 15 and September 17. However, on September 18, she never appeared in the taps.

Why don't they heat the water

Problems with hot water haunt Vitali Klitschko from the first year of his election as mayor.

In 2014, the people of Kiev washed themselves cold for almost the entire September. The mayor then gave rise to the famous meme that "in order for the water to become hot, it must be heated."

In 2017, the Kiev authorities began a conflict with the Kyivenergo company, and in 2018 it officially left the capital's heat power market. KSCA has created a new company - "Kievteploenergo".

True, the state does not sell gas to it - Naftogaz first demands from the mayor's office to pay off more than three billion hryvnias of the previous supplier's debt. 2.6 billion of them are Kiev residents' debts to Kyivenergo, the rest is a state subsidy, which has not reached Naftogaz either.
